Miget® PaaS Terms of Service


1. Introduction

Welcome to Miget®, a Platform as a Service (PaaS) that enables users to deploy their applications to a Git repository, build using Paketo BuildPacks or Docker engine (using Dockerfile), and host on our Kubernetes platform. By using our services, you agree to these terms. If you do not agree, please do not use our services.


2. Intellectual Property Rights

All content, trademarks, service marks, trade names, logos, and icons are proprietary to Miget® or its affiliates, licensors, or users. The Miget® name and logo are copyrighted under trademark numbers 019011061 and 019011094, registered in EUIPO (European Union Intellectual Property Office). You may use the Miget® trademark to promote our service through blog posts, affiliate links, and similar means, provided that you do not use it to promote fake websites, scams, or any other fraudulent or harmful activities. Unauthorized use of the Miget® trademark for malicious purposes is strictly prohibited.


3. Digital Millennium Copyright Act (DMCA)

We respect the intellectual property rights of others. If you believe that your work has been copied in a way that constitutes copyright infringement, please provide our DMCA Agent with the following information:

  • A physical or electronic signature of the person authorized to act on behalf of the owner of the copyright interest.
  • A description of the copyrighted work that you claim has been infringed.
  • A description of where the material that you claim is infringing is located on the site.
  • Your address, telephone number, and email address.
  • A statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
  • A statement by you, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf.


4. Acceptable Use PolicyYou agree not to use the service to:

  • Upload, post, email, transmit or otherwise make available any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, libelous, invasive of another's privacy, or otherwise objectionable.
  • Harm minors in any way.
  • Impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity.
  • Forge headers or otherwise manipulate identifiers in order to disguise the origin of any content transmitted through the service.
  • Upload, post, email, transmit or otherwise make available any content that you do not have a right to make available under any law or under contractual or fiduciary relationships.
  • Upload, post, email, transmit or otherwise make available any unsolicited or unauthorized advertising, promotional materials, "junk mail," "spam," "chain letters," "pyramid schemes," or any other form of solicitation.
  • Upload, post, email, transmit or otherwise make available any material that contains software viruses or any other computer code, files, or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment.


5. Plans and CPU Usage

  • FREE PLAN: The free plan comes with no best effort guarantees and can be limited below 10% CPU cap. This plan is subject to limitations and may not provide consistent performance.
  • Non-PRO Plans: Non-PRO plans come with shared CPU resources and the plan max cap is not guaranteed. Users on these plans may experience variability in performance depending on the overall usage of shared resources.
  • PRO Plans: Only PRO plans come with guaranteed CPU cap, ensuring dedicated resources and consistent performance as per the plan specifications.


6. Data Privacy and Protection

We are committed to protecting your privacy and complying with the General Data Protection Regulation (GDPR). The data processed by Miget® is handled by ipp.net Krzysztof Taraszka, the owner of the Miget® platform.

  • Data Collection: We collect data that you provide directly to us, such as when you create an account or contact us for support. We also collect data automatically through your use of our services, including but not limited to, usage data and technical data.
  • Data Usage: The data we collect is used to provide, maintain, and improve our services, communicate with you, and comply with legal obligations.
  • User Tracking: We use user tracking tools such as Google Analytics to collect information about your interaction with our services. This information helps us understand how our users engage with our platform and improve our services.
  • Data Security: We implement appropriate technical and organizational measures to ensure a level of security appropriate to the risk. However, no method of transmission over the internet or method of electronic storage is 100% secure.
  • Your Rights: You have the right to access, rectify, or erase your personal data, and to restrict or object to its processing. You also have the right to data portability. To exercise these rights, please contact us at data@miget.com


7. Credit Card Information and Billing

We do not store credit card information. Billing and payment processing are managed by our third-party partners, Lemon Squeezy and Paddle. Any issues related to billing should be directed to these providers as we are not responsible for the handling of payment information.

  • Tax Liability: Any tax liability arising from the purchase of our services is managed by Lemon Squeezy and Paddle. We are not a party to these transactions and are not responsible for any tax-related matters.


8. Service Level Agreement (SLA)

  • Miget® PRO: The SLA is 99.95%.
  • Miget® Offer: The SLA is 99.9%.
  • FREE Miget® Offer: There is no SLA.

The SLA excludes issues such as bugs in the code, resource exhaustion causing Kubernetes Pod not to come up (e.g., crashing due to OOM), or misconfiguration caused by end-user App configuration.


9. Service Availability and Liability

While we strive to provide continuous and reliable service, Miget® cannot be held responsible for any damages resulting from the interruption or cessation of services. This includes, but is not limited to, loss of income for an App owner during downtime. Service disruptions may occur due to issues with our upstream hosting provider or other factors beyond our control. We reserve the right to suspend services if necessary.


10. Pricing

Our prices are VAT excluded. The final price depends on the country of residence of the platform user, the type of user (private or business), and it is the right of Paddle or Lemon Squeezy to apply the proper VAT.


11. Modifications to Service

Miget® reserves the right to modify or discontinue, temporarily or permanently, the service (or any part thereof) with or without notice. You agree that Miget® shall not be liable to you or to any third party for any modification, suspension, or discontinuance of the service.


12. Termination

You agree that Miget®, in its sole discretion, may terminate your password, account (or any part thereof), or use of the service, and remove and discard any content within the service, for any reason, including, without limitation, for lack of use or if Miget® believes that you have violated or acted inconsistently with the letter or spirit of these terms. Miget® may also in its sole discretion and at any time discontinue providing the service, or any part thereof, with or without notice.


13. Disclaimer of Warranties

You expressly understand and agree that:

  • Your use of the service is at your sole risk. The service is provided on an "as is" and "as available" basis.
  • Miget® makes no warranty that (i) the service will meet your requirements, (ii) the service will be uninterrupted, timely, secure, or error-free, (iii) the results that may be obtained from the use of the service will be accurate or reliable, (iv) the quality of any products, services, information, or other material purchased or obtained by you through the service will meet your expectations, and (v) any errors in the software will be corrected.


14. Limitation of Liability

You expressly understand and agree that Miget® shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses (even if Miget® has been advised of the possibility of such damages), resulting from: (i) the use or the inability to use the service; (ii) the cost of procurement of substitute goods and services resulting from any goods, data, information, or services purchased or obtained or messages received or transactions entered into through or from the service; (iii) unauthorized access to or alteration of your transmissions or data; (iv) statements or conduct of any third party on the service; or (v) any other matter relating to the service.


15. Governing Law

These terms and your use of the service are governed by and construed in accordance with the laws of the jurisdiction in which Miget® operates, without regard to its conflict of law principles.
